By accessing or using Arabs Abroad's Services, you acknowledge that you have read, understood, and agree to comply and be bound by these Terms, as well as any other applicable policies, guidelines, or agreements incorporated herein. If you do not agree with these Terms, you may not use our Services. We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Services or via email. Unless otherwise specified, the updated Terms will take effect immediately, and your continued use of the Services constitutes acceptance of the updated Terms, which will apply retroactively to all interactions going forward. Please review these Terms regularly for any changes.
Certain Services may be subject to additional or different terms, which will become part of your agreement with us upon your use of those Services. In case of any conflict between these Terms and any additional terms, the additional terms will govern with respect to that conflict. 3. Account Creation & Management
3.1. Account Creation
In order to access certain features or functionality of the Services, you may be required to register for a Arabs Abroad account. The scope of access and functionality available to you will depend on the specific subscription plan you select, and Arabs Abroad reserves the right, at its sole discretion, to modify, amend, or discontinue any features or aspects of the Services, including the available subscription plans, at any time without prior notice.
You agree to provide accurate, current, and complete information during the registration process and to promptly update such information whenever it changes. Failure to provide accurate or up-to-date information may result in the suspension, limitation, or termination of your account, at Arabs Abroad's sole discretion.
By registering for a Arabs Abroad account, you affirm that you are legally permitted to do so under applicable laws and that you reside in the United States or one of its territories. Arabs Abroad reserves the right to suspend or terminate any account that does not meet these eligibility requirements.
3.2. Account Security
You are solely responsible for maintaining the confidentiality and security of your account and login credentials. You agree to take all reasonable precautions to protect your account, including but not limited to using strong, unique passwords and not sharing your login information with third parties. If you believe or become aware that your account credentials have been compromised or that any unauthorized access has occurred, you must immediately notify Arabs Abroad and take steps to secure your account.
3.3. Account Termination
Arabs Abroad may revoke or terminate your access or use of the Arabs Abroad Services for any reason without notice at Arabs Abroad's sole discretion. Without limiting the generality of the foregoing, we may revoke or terminate the License if you: (i) breach any obligation in these Terms or in any other agreement between you and us, (ii) violate any policy or guideline applicable to the Arabs Abroad Services, or any other Arabs Abroad product or service, or (iii) use the Arabs Abroad Services other than as specifically authorized in these Terms, without our prior written permission.
3.4. Minimum Age
Users must be at least 18 years old to use our Services, in compliance with applicable laws and regulations. By accessing or using the Services, you represent and warrant that you are at least 18 years of age. If you do not meet this requirement, you may not use our Services.
4. Use of Services
4.1. Purpose
Arabs Abroad serves as a digital platform designed to connect users with a range of local offerings, including, but not limited to, promotional discounts, events, experiences, and job opportunities, all intended to enhance community engagement and expand access to valuable services within a defined geographic area.
4.2. Paid Services & Subscriptions
While using Arabs Abroad is generally free, the platform offers both free features and optional paid services (the "Paid Services") for individual users and business users. Paid Services may be offered as subscriptions with different durations (such as 1-month or 3-month plans). Subscriptions can be managed only through the Arabs Abroad website (habibiplus.com).
4.2.1. Payment through the Service
Arabs Abroad offers certain enhanced features of the Services which you can purchase through a subscription. The amount due for a Subscription will be presented to you before you complete your purchase. By purchasing a Subscription through the Arabs Abroad website, you agree to pay the applicable subscription fees and any taxes using Stripe, the secure payment processor. All payments for Subscriptions are non-refundable and non-transferable, except as expressly provided in these Terms.
4.2.2. Cancellation
You are under no obligation to continue your Subscription and may cancel at any time prior to the start of your next billing period. To cancel your Subscription, you must access the cancellation settings on the Arabs Abroad website and initiate cancellation at least 48 hours before your next payment date.
4.2.3. Free Trial
If you enroll in a free trial for a Paid Service, you will automatically be charged at the end of the trial period unless you cancel at least 48 hours before the end of the trial through the Arabs Abroad website.
BY PURCHASING A SUBSCRIPTION OF ANY KIND ON ARABS ABROAD, YOU ACKNOWLEDGE YOU HAVE READ AND AGREE TO THESE TERMS AND UNDERSTAND THAT YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW UNTIL YOU TAKE ACTION TO CANCEL.
5. User Content & Responsibilities
Arabs Abroad allows you and other users to create, post, store, and share content, including but not limited to messages, text, photos, graphics, videos, software, code, logos, and other materials (collectively, "User Content"). Unless otherwise specified, you retain all rights to your User Content. By posting or sharing User Content on the Arabs Abroad platform, you grant us a perpetual, irrevocable, nonexclusive, royalty-free, worldwide, fully paid, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your User Content in all media formats and channels now known or later developed, without compensation to you.
6. Prohibited Conduct
By using the Services, you agree to comply with all applicable laws, regulations, contractual obligations, intellectual property rights, and third-party rights. You agree not to engage in misuse of Services, harassment and abuse, deceptive practices, spam, impersonation, intellectual property violations, reverse engineering, unauthorized data collection, or any other prohibited activity outlined in our full Terms.
7. Third-Party Materials & Content
The Services provided by Arabs Abroad may include or make accessible third-party materials. These Third-Party Materials are not within Arabs Abroad's control. Arabs Abroad is under no obligation to monitor Third-Party Materials, and we reserve the right, at our sole discretion, to block, restrict, or disable access to any such materials at any time and without prior notice.
8. Intellectual Property & Limited License
The Arabs Abroad Services, including all text, graphics, images, photos, videos, illustrations, and other content, are owned by Arabs Abroad or its licensors and are protected by U.S. and international intellectual property laws. Provided that you comply with these Terms, we grant you a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use the Services.
9. Trademarks
The name "Arabs Abroad," the domain "habibiplus.com," the "Arabs Abroad" logo, and all other related trademarks, service marks, and trade names are the exclusive property of Arabs Abroad and are protected by applicable intellectual property laws. These marks may not be copied, reproduced, imitated, or otherwise used without the express prior written consent of Arabs Abroad.
10. Feedback
By submitting any Feedback regarding Arabs Abroad or its Services, you grant Arabs Abroad a perpetual, worldwide, royalty-free, irrevocable, and fully transferable license to use such Feedback in any manner, for any purpose, commercial or otherwise, without any obligation of acknowledgment or compensation to you.
11. Copyright & Intellectual Property Violations
If you believe that any content on our Services infringes your intellectual property rights, you may report such violations to Arabs Abroad by using the designated report function within the app. In compliance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, Arabs Abroad maintains a policy of terminating the accounts of users who are found to repeatedly infringe upon the intellectual property rights of others.
12. Disclaimers
Your use of Arabs Abroad's Services is solely at your own risk. The Services and all content available therein are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Arabs Abroad makes no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of the Services.
13. Limitation of Liability
To the fullest extent permitted by applicable law, neither Arabs Abroad nor any of its affiliates, directors, officers, employees, agents, or licensors shall be liable to you for any indirect, consequential, incidental, special, punitive, or exemplary damages, or for any loss of profits, revenue, data, business opportunities, or goodwill.
14. Assumption of Risk
By accessing or using the Arabs Abroad platform and its associated services, you acknowledge and agree that your participation is at your own risk. Arabs Abroad does not warrant or guarantee the accuracy, completeness, reliability, or legality of any content, products, services, or interactions provided by other users or third parties on the platform.
15. Release of Liability
By using the Arabs Abroad platform and its services, you hereby release, waive, and discharge Arabs Abroad, its affiliates, officers, employees, agents, licensors, and partners to the fullest extent permitted by applicable law from any and all claims, demands, actions, suits, damages, losses, or liabilities arising out of or in connection with your use of the platform.
16. Dispute Resolution
16.1. Binding Arbitration
By using the Arabs Abroad platform, you agree that any disputes or claims arising out of or relating to these Terms, or your use of the platform will be resolved through binding arbitration, rather than in court. You and Arabs Abroad agree that arbitration will be conducted on an individual basis only, and not as a class action, collective action, or representative proceeding.
16.2. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Arabs Abroad, its subsidiaries, affiliates, officers, directors, agents, partners, and employees from and against any and all losses, liabilities, claims, demands, damages, expenses, costs, fines, penalties, or other liabilities arising out of your use of the Services.
17. Governing Law & Venue
Any dispute arising from these Terms and your use of the Services will be governed by and construed in accordance with the laws of Florida, except to the extent preempted by U.S. federal law, without regard to conflict of law rules or principles.
18. Modification & Termination of Services
Arabs Abroad reserves the right, at its sole discretion, to modify, suspend, or discontinue all or any portion of the Services at any time, with or without notice to you. You acknowledge and agree that Arabs Abroad shall not be liable to you or any third party for any modification, suspension, or termination of the Services.
19. Miscellaneous
If any provision of these Terms is found to be unlawful, void, or unenforceable, such provision shall be deemed severable from these Terms and shall not affect the validity of the remaining provisions. The failure or delay by Arabs Abroad to exercise or enforce any right under these Terms shall not be construed as a waiver of such right.
